Moving Services Agreement & Liability Waiver

Heavy Lifters LLC · Version 2026-10-15.3 · Effective October 15, 2026
Florida Registered LLC · USDOT #4262136

This Moving Services Agreement ("Agreement") is between Heavy Lifters LLC ("Heavy Lifters," "we," "us") and the person booking the move ("Customer," "you"). By checking the box and typing your name at checkout, you agree to this Agreement and confirm that you are at least 18 years old and are the owner of the goods to be moved, or are authorized by the owner to arrange the move.

1. Services and Estimate

1.1 We will provide the labor, and, if selected, the moving truck, described in your booking: the crew size, estimated hours, date, arrival time, addresses and notes you provide ("Booking").

1.2 Your online price is an estimate, not a binding quote. It is based only on the information you give us. Your final charge is calculated from the actual time worked at your crew's hourly rate, plus applicable fees.

1.3 Your booking is a request until we confirm it. If we cannot accept it, we will refund your deposit in full.

2. Rates, Time and Fees

2.1 Hourly rates are: 2 movers $150/hr, 3 movers $210/hr, 4 movers $300/hr. A 2-hour minimum applies to every job.

2.2 Billable time starts when the crew arrives at the first address and ends when the work at the last address is finished. It includes driving time between your addresses, and is billed in 15-minute increments after the minimum.

2.3 Flat fees: truck fee $150 when we provide the moving truck for a move within a 30-mile radius of Orlando (for longer distances, the truck fee may change based on mileage and truck size, and we will confirm it with you before your move). There is no separate fee for stairs, but you must tell us about stairs at any address (see Section 2.4).

2.4 Additional time or charges may apply if the job differs from your Booking, including: extra items or stops; items not packed or ready when the crew arrives; stairs or long carries you did not tell us about, elevators, or restricted or distant parking; waiting time caused by you, your building, HOA or other parties; furniture disassembly or reassembly not disclosed; and items over 300 lbs (such as pianos, safes or gym equipment) that were not disclosed in advance. We will tell you about any change in scope before doing the additional work, when practical.

2.5 Parking tickets, tolls, building or HOA move fees, and permits needed because of your location are your responsibility.

3. Deposit, Payment, Cancellation and Rescheduling

3.1 A $100 deposit is required to reserve your date and time. It is applied to your final bill. If you pay by credit card, a 3% card processing fee is added to the deposit; there is no fee for debit cards. The card fee is refunded only if your deposit is refunded.

3.2 Deposits are non-refundable. We turn away other work to hold your time, so a deposit is not refunded if you cancel, for any reason, except as stated in Sections 1.3 and 3.4.

3.3 Rescheduling: if you reschedule at least 72 hours before your scheduled arrival time, we will apply your deposit to your new date, as long as the new date is within 6 months. If you reschedule with less notice, cancel, do not show, or the job cannot go ahead when the crew arrives because of you (for example: no access, not ready, no authorized adult present, or unsafe conditions), your deposit is forfeited.

3.4 If we must cancel or reschedule (for example, severe weather, an emergency or equipment failure), you may choose a full deposit refund or a new date. This, and Section 1.3, are the only cases in which a deposit is refunded. Our liability for a cancellation by us is limited to refunding your deposit.

3.5 The balance is due when the work is completed, before the crew leaves. We accept the payment methods listed at booking or confirmed by our team. Returned or reversed payments may incur a $35 fee plus any collection costs allowed by law. You agree not to dispute a card charge for services that were performed without first contacting us to resolve the issue.

4. Your Responsibilities

You agree to:

  • Give accurate and complete information about the addresses, items, stairs, elevators, access and parking, and tell us about any hazards (for example: loose railings, damaged flooring, pests, mold or aggressive animals).
  • Have an adult (18+) with authority to make decisions present at the start and end of the job, or as agreed.
  • Reserve elevators and loading docks, get any HOA or building approvals, and provide legal parking for our truck close to the entrance.
  • Have everything packed, sealed and ready unless you booked packing help. Empty drawers of fragile, loose or valuable contents.
  • Empty, defrost and dry refrigerators and freezers, and drain washers, at least 24 hours before the move.
  • Disconnect and reconnect appliances, electronics and fixtures. Our crew does not perform electrical, plumbing, gas or wall-mounting work and does not disconnect gas lines.
  • Keep children and pets safely away from the work area.
  • Not move items yourself alongside the crew in a way that creates a safety risk. You and your guests take part at your own risk.

5. Items We Do Not Move

5.1 We will not transport: hazardous or flammable materials (such as gasoline, propane tanks, paint, solvents, chemicals, fireworks or ammunition), illegal items, perishable food, live plants or animals, or items infested with pests.

5.2 Keep these with you: cash, jewelry, precious metals, collectibles, firearms, important documents, medications, keys, computers and data storage devices, and items of extraordinary or sentimental value. If you choose to have us move any of these anyway, you do so at your own risk, and they are subject to the limits in Section 6.

5.3 We may refuse to move any item, or stop work, if moving it would be unsafe or unlawful, or if anyone on site is abusive or threatening toward our crew. Time worked up to that point is billable.

6. Liability for Loss or Damage (Valuation)

6.1 Basic coverage (included at no charge). Unless you declare a higher value in writing before the move and we agree to it, our liability for loss of or damage to any item is limited to $0.60 per pound per article. This is the basic released value used by movers in Florida. For example, if a 50-lb television is damaged, our maximum liability is $30. This is not insurance; it is a limit on the amount of our liability.

6.2 Higher protection. You may ask us in writing, before the move, about declaring a higher value. You may also buy separate moving insurance or check your homeowner's or renter's policy. You acknowledge that you were offered this choice.

6.3 We are not liable for:

  • Damage to the contents of boxes you packed yourself, unless the box itself shows external damage caused by us.
  • Furniture made of particleboard, pressboard or MDF, or previously repaired or damaged items, beyond what is caused by our negligence.
  • The mechanical, electrical or internal function of appliances, electronics, clocks, instruments or similar items, unless there is visible external damage caused by us.
  • Items listed in Section 5, or undisclosed items worth more than $100 per pound.
  • Normal wear, minor scuffs from moving pads, or changes caused by heat or humidity (such as candles, vinyl records or plants).
  • Damage resulting from your instructions after we warned you of the risk (for example, forcing an item through an opening that is too small).
  • Loss or damage caused by fire, flood, storm, theft by others, acts of God, or other events outside our control.
  • Items left in, or loaded or unloaded by, anyone other than our crew.

6.4 Property damage. We take reasonable care to protect floors, walls, doors and railings. We are responsible only for property damage caused by our negligence that you point out to the crew before they leave, or report in writing within 24 hours. We are not responsible for pre-existing damage, or for damage caused by loose, weak or defective structures that you did not disclose.

6.5 We are not liable for indirect or consequential losses, such as lost wages, hotel stays, missed closings or lease penalties, or for delays caused by weather, traffic, road closures, building or HOA restrictions, or other causes outside our control.

6.6 Nothing in this Agreement limits liability for our gross negligence or intentional misconduct, or any right you have that cannot be waived under Florida law, including Chapter 507 of the Florida Statutes.

7. Inspection and Claims

7.1 Please inspect your belongings and the property before the crew leaves, and note any visible damage or missing items on your completion confirmation.

7.2 Claims must be submitted in writing within 30 days of the move to imuv247@gmail.com, with photos and a description. Keep damaged items until we have had a reasonable chance to inspect them. We may choose to repair, replace or pay for a damaged item, up to the limits in Section 6.

7.3 Payment of your balance is not conditional on resolving a claim.

8. Release and Indemnity

8.1 To the fullest extent allowed by Florida law, you release Heavy Lifters LLC and its owners, employees and contractors from claims for injury, loss or damage that arise from: your own or your guests' participation in moving items; conditions at the properties that you knew about and did not disclose; or items described in Section 5. This release does not apply to injury or damage caused by our gross negligence or intentional misconduct.

8.2 You agree to indemnify us against third-party claims (for example, from a landlord, HOA or building) arising from inaccurate information you gave us or from your breach of this Agreement.

9. Communications and Photos

9.1 You agree that we may contact you by phone, text message and email about your booking. Message and data rates may apply. Reply STOP to opt out of texts.

9.2 Our crew may take photos of items and property conditions before, during and after the move for documentation and claims. We will not publish photos showing your home or belongings without your permission.

10. General

10.1 This Agreement, your Booking confirmation, and our written confirmation of any changes are the entire agreement between us about the move. Changes must be confirmed in writing, including by email or text.

10.2 This Agreement is governed by Florida law. Before filing any claim, both parties agree to try in good faith to resolve the dispute by contacting each other. Any lawsuit must be brought in the courts of Orange County, Florida, including small claims court.

10.3 If any part of this Agreement is found unenforceable, the rest remains in effect, and the unenforceable part will be limited to the minimum extent necessary.

10.4 Electronic signature. Checking the box, typing your full name and drawing your signature is your electronic signature and has the same effect as a handwritten signature. We keep the image of your drawn signature and record the date, time, version and device information of your signature, and email you a link to this Agreement.
